Emerald Who's Who, Inc. maintains the Emerald Who's Who site to service its customers. To Protect visitor personal information of visitations to the site, and to ensure a pleasant shopping experience for all customers, Emerald Who's Who, Inc. has established "terms of use" ("Terms") that set forth what you can expect from the Emerald Who's Who site, and what we can count on from you as a user of the site. By using this site, you are agreeing to comply with and be bound by the Terms, which may change from time to time.

Some states do not allow the exclusion or limitation of liability of consequential or incidental damages, so the above exclusions may not apply to you; in such states, liability is limited to the fullest extent permitted by law.

The Emerald Who's Who site (excluding linked sites) is controlled by Emerald Who's Who, Inc. from its offices within the State of New York, United States of America. Since it can be accessed from all 50 states, as well as from other countries around the world, and each of these places has laws that may differ from those of New York, by accessing the Emerald Who's Who site both you and Emerald Who's Who, Inc. agree that the statutes and laws of the state of New York, without regard to the conflicts of laws principles thereof, will apply to all matters relating to use of the site and its contents. You and Emerald Who's Who, Inc. further agree to submit to the exclusive personal jurisdiction and venue of the Superior Court of the appropriate County and the United States District Court for the Northern District of New York with respect to any matters relating to use of the site and its contents, or any transactions arising from such use.

Special Legal Considerations

You must possess the legal right and ability to use the Emerald Who's Who site. Without limiting the foregoing, you agree to be financially responsible for any purchase(S) you place on or in connection with the Emerald Who's Who site and/or the Content may not be suitable for all visitors. You agree to comply with all applicable laws, rules and regulations concerning your access to and/or use of such portion(s) of the Emerald Who's Who and/or the Content, including any internal rules regarding your access to and/or use of the site (e.g. any applicable rules and or policies of your employer or Internet Service Provider). EMERALD WHO'S WHO RESERVES THE RIGHT TO CHANGE THE FOREGOING TERMS AT ANY TIME BY POSTING CHANGES ON-LINE. YOU ARE RESPONSIBLE FOR REVIEWING INFORMATION POSTED ON-LINE TO OBTAIN TIMELY NOTICE OF SUCH CHANGES. YOUR CONTINUED VISITS, USE OF THE SERVICES AND/OR PURCHASE OF MERCHANDISE THROUGH THE EMERALD WHO'S WHO SITE CONSTITUTES YOUR ACCEPTANCE OF THESE TERMS, AS MODIFIED BY ANY POSTED CHANGES.

Under no circumstances will Emerald Who's Who, Inc. or any of its affiliates sell, barter or give away your personally identifying information to a third party for any reason, including for marketing purposes. Nor will Emerald Who's Who, Inc. or any of its affiliates ever disclose your personal address book to any party, for any reason. Notwithstanding the foregoing, Emerald Who's Who, Inc. reserves the right to cooperate with local, state, and federal officials in any investigation relating to any purported illegal activity(ies) of any user.

We take the privacy of your personal information very seriously. This is why we use Secure Socket Layers (SSL), the most advanced security system available. All of the personal information you enter, including your name, address, credit card information and the contents of your address book, is encrypted by our secure server software into indecipherable bits before it is safely transmitted across the Internet. To ensure that the information from your address book and profile is even more secure, we store it on a server that isn't accessible on the Internet and is password protected. Once we store that information, it won't be displayed anywhere on Emerald Who's Who.
